70% Tax Penalty on Crypto Gains? Here’s What You Need to Know!

India Tightens Crypto Tax Rules While Reassessing Policy: What It Means for You

India’s Crypto Policy Gets a Second Look

India is rethinking its stance on cryptocurrencies, potentially signaling a shift in regulatory policies. This move comes as global acceptance of digital assets grows, especially in countries like the United States, where crypto-friendly policies are gaining traction.

Ajay Seth, India’s Economic Affairs Secretary, recently acknowledged that multiple countries are adjusting their crypto regulations, pushing India to reassess its own approach. This could mean a more flexible policy in the near future, offering the industry a chance to thrive under clearer guidelines.

Why This Matters

India has been a leader in grassroots crypto adoption, with projections suggesting that Web3 could contribute over $1.1 trillion to the country’s GDP by 2032. However, without a clear and supportive regulatory framework, industry leaders warn that India may miss out on significant economic opportunities.

Sumit Gupta, co-founder of CoinDCX, emphasized the need for a structured and friendly regulatory approach. He urged the government to prioritize releasing a discussion paper to create a progressive policy that aligns with global trends.

Stricter Crypto Tax Rules Shake the Industry

Even as India revisits its broader crypto stance, the government has introduced tough new tax measures that could make trading and investing in digital assets more challenging.

Key Changes in Crypto Taxation

  • Undeclared crypto gains will face a 70% penalty – The new tax rules will retroactively apply to the past four years.
  • Classification as Virtual Digital Assets (VDAs) – Crypto is now officially categorized under VDAs and subjected to increased taxation.
  • Mandatory Reporting by Crypto Businesses – Starting April 2026, companies dealing with crypto must disclose all transactions to tax authorities.
  • Strict 30-Day Correction Period – Businesses have only 30 days to correct discrepancies in their tax filings.
  • Detailed Disclosure Requirements – Companies must report participant details, asset types, and trade values.

What This Means for Crypto Traders

Experts warn that such rigid tax policies could drive traders and investors toward underground markets or offshore exchanges, making it harder for authorities to monitor and regulate the sector.

Sumit Gupta from CoinDCX criticized the framework, suggesting that a 0.01% TDS (Tax Deducted at Source) rate and allowing the offset of trading losses would have been a more effective approach. He believes that such policies would encourage compliance while also increasing government revenues.

The Future of Crypto in India: A Balancing Act

While India’s reconsideration of its crypto policy is a positive step, the stricter tax measures could stifle growth in the industry. Many experts argue that a more balanced regulatory framework—one that fosters innovation while ensuring compliance—will be essential for India to remain competitive in the global blockchain economy.

As the crypto landscape continues to evolve, traders and businesses will need to adapt to these changes while navigating the complexities of taxation and compliance.

Final Thoughts

If India wants to lead the Web3 revolution and capitalize on its potential $1.1 trillion contribution to GDP, the government must create policies that encourage growth rather than push traders to non-compliant alternatives. The next few months will be crucial in determining the future of crypto in India.
